    Hosts: School of Law, Seoul Nat'l University /School of Law, Santa Clara University

     

    School of Law at Seoul National University proudly announces its first Summer IP Institute (SIPI) in collaboration with School of Law at Santa Clara University. The Institute will offer Four(4) Sessions in IP Law, IP Licensing, IP Strategy, and IP Business from June 14, 2010 to August 9, 2010 in the campus of Santa Clara University which is conveniently located in the heart of the Silicon Valley, The Mecca of world's IP industry.
     
    EDUCATION PROGRAMS
     SESSION 1: IP STRATEGY (June 14 - June 27, 2010)
     Features: essence of IP management and utilization through consolidating the basics of patent and trade secrets law
     Recommendation: anybody engaged in the IP industry
    (A) IP MANAGEMENT and LITIGATION STRATEGIES
     Strategies for identifying IP in enterprises,  Strategies for optimal IP protection and maintaining IP rights,  Working hypothetical,  Strategies in IP litigation,  Discussion on working hypothetical
    (B) US PATENT LAW and TRADE SECRETS LAW
     Overview of US patent law,  Comparison with int'l patent law,  Interference practice,  Developing patent strategies,  Working hypothetical,  Overview of US trade secrets law and its role in biotechnology/semiconductor industry,  Comparison with int'l trade secrets law, (e.g., laws of confidentiality),  Discussion on working hypothetical
     
    SESSION 2: IP LICENSING (June 28 - June 11, 2010)
     Features: IP licensing in parallel with copyright and trademark law
     Recommendation: those engaged in IP licensing, IP transaction, technology transfer.
    (A) IP LICENSING
     Overview of IP transaction,  Key IP transaction provisions ,  Working hypothetical on IP transaction,  Unique provisions of IP rights in IP transaction,  Discussion on working hypothetical
    (B)US COPYRIGHT LAW and TRADEMARK LAW
     Overview of copyright law and entertainment law,  Comparison with int'l copyright law (e.g., design rights),  Working hypothetical on copyright and trademarks,  Overview of trademark and unfair competition law and their roles in industry,  Branding strategies,  Comparison with int'l trademark law (e.g., passing off),  Discussion on working hypothetical
     
    SESSION 3: IP ENTREPRENEURSHIP (July 12 - July 25, 2010)
     Features: entrepreneurship through IP and strategies to strengthen entrepreneurship through IP acquisition and litigation
     Recommendation: those aspiring to participate in a start-up business as an inventor, a founder, a manager, a counsel, and an angel
    (A) SPECIAL IP BUSINESS ISSUES and FUNDING COMPANIES
     IP acquisition in business context,  Unique issues for start-up technology companies,  Unique industry issues,  Working hypothetical on IP in technology companies,  Open source,  Biotechnology,  DMCA,  Overview of venture capitals and other funding sources,  Role of IP in funding decisions,  Discussion on working hypothetical
    (B) STRATEGIES IN IP ACQUISITION AND IP LITIGATION
     Economics of IP,  IP valuation and licensing,  IP business planning,  Employee incentives and education programs,  Working hypothetical,  Creation of IP review boards,  Strategies in enforcing IP,  Extensive components in IP licensing,  Discussion on working hypothetical
     
    SESSION 4: IP DISPUTE RESOLUTION (July 26 - August 8, 2010)
     Features: disputes resolution stemming from disputes and issues related resolution including Markman Hearing, antitrust, patent portfolio, mediation, and negotiation
     Recommendation: IP managers in various settings, including those who have to resolve the IP disputes in the courts or through business tactics
    (A) MARKMAN HEARINGS and ANTITRUST
     Markman Hearing in patent litigation,  Rules of intrinsic and extrinsic evidence during Markman Hearing,  Claim construction,  Working hypothetical on Markman Hearing,  US bankruptcy law,  US antitrust law,  Creating entrance barriers using IP,  Discussion on working hypothetical
    (B) PATENT DISPUTE RESOLUTION and PATENT PORTFOLIO

    SITE VISITS AND TRAINING PROGRAMS
      Silicon Valley incubators (in which start-up companies are born)
     Silicon Valley venture capitalists at their offices on the famous Sand Hill Road
     Cutting-edge technology "campuses," such as eBay, Apple, or Google
     U.S. District Court, California Superior Court, and/or California Circuit Court
     Meetings with local judges in their courtrooms or visiting courts
     Silicon Valley IP law firms such as Orrick Herrington & Sutcliffe,

     Site visits and training schedule for each Session will be finalized in May 2010.

    Lori N. Boatright, Partner, Blakely Sokoloff Taylor & Zafman (Los Angeles)
     Ms. Boatright received J.D. from University of Missouri School of Law.
     She is the Chair of Blakely's Trademark Practice Group.
    Rick Chang, Partner, McDermott Will & Emery (Silicon Valley)
     Mr. Chang received J.D. from U. of California, Berkeley, Hastings College of Law.
     He is an established patent litigator representing his clients in federal courts and ITC.
    Helen A. Christakos, Associate, Greenberg Traurig (Silicon Valley), Adjunct Prof. at SCU
     Ms. Christakos received J.D. from U. of California, Berkeley, Hastings College of Law.
     Her areas of interests include IP licensing, M&A, and internet and e-commerce.
    Dorothy J. Glancy, Professor of Law, Santa Clara University
     Prof. Glancy received J.D. from Harvard Law School and was a counsel of the U.S. Senate Judiciary Committee.
     She teaches classes in copyright law, trademark law, and property.
    David A. Kays, Partner, McDermott Will & Emery (Silicon Valley)
     Mr. Kays received J.D. from University of San Francisco School of Law.
     He is an experienced trial lawyer and his practice focuses on dispute resolution.
    Thomas Klein, Partner, Greenberg Traurig (Silicon Valley)
     Mr. Klein received J.D. from University of Chicago School of Law.
     His areas of concentration include start-ups, venture capital, M&A. joint venture, etc.
    Fabio Marino, Partner, Orrick Herrington & Sutcliffe
     Mr. Marino received J.D. from U. of California, Berkeley, Hastings College of Law.
     He also received B.S. and M.S. in computer science and is a well-known litigator.
    Nisha Mody, Ph.D., Managing Principal, The CapAnalysis Group (San Francisco)
     Dr. Mody received Ph.D. from U. of Southern California in political economy.
     She is an expert in providing financial and economic consulting on IP cases, business valuation cases, antitrust cases, among others.
    Catherine J. K. Sandoval, Professor of Law, Santa Clara University
     Prof. Sandoval received J.D. from Stanford University School of Law and worked as Undersecretary of the State of California, Business/Transportation/Housing Agency.
     She teaches antitrust, and specializes in regulated industries and administrative law.
    Edwin H. Taylor, Partner, Blakely Sokoloff Taylor & Zafman (Silicon Valley)
     Mr. Taylor received J.D. from St. Mary University School of Law
     His major areas of practice include business-related patent transactions, strategic IP planning, and portfolio evaluation, both for purchase, sale, and litigation.
    Edwin H. Wheeler, Partner, McDermott Will & Emery (Silicon Valley)
     Mr. Wheeler received J.D. from University of Chicago School of Law.
     His practice focuses on IP litigation, antitrust, and other complex commercial issues.
    Honorable Ronald M. White, Judge, US District Court for Northern District of CA (San Jose)
     Judge White received J.D. from U. of Southern California School of Law.
     He has been sitting in the District Court for ND, CA since 1992.
